Frequently Asked Questions
1. What is the process for debt recovery / collection? We use completely legal pre-court and court methods to recover debt; including notices of demand, mediation, negotiations, settlement agreements, escalation to litigation, garnishee proceedings, seizure and sale of property, judgment debtor summons, bankruptcy/winding up proceedings. We focus on the most effective methods with minimal upfront cost to you. Our expertise is to secure payment quickly, cost-effectively, and within the law.
2. How long does the debt recovery process take? For our pre-court recovery service, we usually require up to 8 weeks to obtain a response from the debtor. If they remain completely unresponsive, we return the file to you with no further charges. For court proceedings, timelines vary depending on the complexity of your matter. We’ll give you a realistic assessment before you decide whether to proceed.
3. How are your fees structured? Our fee structures are compliant with Bar Council rules. We work on cost-effective fee models designed to keep costs proportionate to your results. For an accurate quotation, reach out to us on WhatsApp for a free case assessment. We’ll explain clearly what fees apply and what options you have before you commit.
4. Is there a minimum debt amount? We are able to take on cases involving debts as low as RM 5,000. Contact us for a free case assessment.
5. What documents do I need to prepare? We can start with as little as a summary of your outstanding debt (showing total claim sum) and the debtor's contact details. We will advise you if more detailed documentation is required. Don't worry if your documents are incomplete. We’ve resolved numerous cases even with limited paperwork. Every claim is worth assessing — don’t write off your debt just because you lack a formal contract.
6. Are your recovery methods legal? Absolutely. We are a law firm regulated by the Malaysian Bar Council. We are not “debt collectors.” All our methods are legal, professional, and enforceable in court. Our focus is always on protecting your rights — while safeguarding your business reputation.
7. Will I be updated on my case progress? We will provide you with all important updates via direct WhatsApp communication with the lawyer in charge of your case. We pride ourselves on our responsiveness and diligent case follow-ups.
8. Will I end up being dragged into litigation? Not necessarily. Most disputes can be tested quickly. We press the debtor to put their defense in writing—if it’s weak or a delaying tactic, we can neutralize it early through mediation. Full-blown trials are the last resort, not the first step.
9. I tried another firm/collector before with no results. Why will this be different? Many collectors rely on calls and pressure tactics, which are easy for debtors to ignore; as they carry no legal weight. Some firms file cases without first checking if recovery is viable; saddling you with unnecessary upfront costs with no guarantee of results. Our difference: we focus on the quickest and most cost-effective legal methods of recovery and often push for quick settlements backed by legal consequences. That avoids wasted fees and time.
10. The debtor is outside my state or overseas—can you handle that? Yes, we can. We’ve handled many cross-border matters and will guide you on the most cost-effective ways to proceed.
11. Can my case be resolved without going to court? Absolutely. Court should always be the last resort. Our first approach is pre-court: letters of demand, mediation, strategic escalation, structured settlements, and binding agreements. Many cases resolve here—fast, cost-effective, and private. Litigation is only considered if the debtor refuses all reasonable settlement options.
12. Will hiring a law firm hurt my relationship or reputation with the debtor? Not if handled properly. We keep communication professional, discreet, and free from illegal “intimidation tactics.” Our approach prioritizes solutions, not improper threats. This preserves your commercial reputation and, in many cases, allows you to continue doing business once the matter is resolved.
